These Standard Trading Conditions apply to all services provided by Eston Ltd (hereinafter referred to as "the Company"). By booking a service with us, the Customer agrees to be bound by these terms. Please read them carefully before engaging our services.

1. Definitions

In these conditions, the following definitions apply:

  • "Company" refers to Eston Ltd.
  • "Customer" refers to any person or entity at whose request or on whose behalf the Company undertakes any business.
  • "Goods" refers to the cargo to be handled, transported, or stored, including any packaging.

2. Customer Obligations

The Customer warrants that:

  • The description and particulars of any Goods furnished by the Customer are complete and accurate.
  • The Goods are properly packed, marked, labeled, and stowed in a manner appropriate for transport.
  • They have the authority to enter into this contract on behalf of the owner of the Goods.

3. Payment Terms

Unless otherwise agreed in writing, all invoices are due for payment within 30 days of the invoice date. The Company reserves the right to charge interest on overdue amounts at a rate of 8% above the Bank of England base rate. Queries regarding invoices must be raised within 7 days of receipt.

4. Liability & Insurance

The Company carries Goods in Transit (GIT) insurance in accordance with RHA (Road Haulage Association) or CMR conditions where applicable.

  • The Company shall not be liable for loss or damage caused by events beyond our reasonable control (Force Majeure), such as strikes, weather conditions, or customs delays.
  • Customers are strongly advised to obtain their own "All Risks" marine cargo insurance for high-value items.

5. Dangerous & Prohibited Goods

The Customer must not tender for transport any dangerous, hazardous, or combustible goods without prior written notice to the Company. If such goods are handed over without declaration, the Customer shall be liable for all loss, damage, or expenses arising from such goods.

6. Cancellation Policy

Bookings cancelled within 24 hours of the scheduled collection time may incur a cancellation fee of up to 50% of the agreed rate. Cancellations made after the vehicle has been dispatched will be charged at 100% (Dead Freight).

7. Waiting Time (Demurrage)

A standard loading/unloading time of 60 minutes is allocated for deliveries. Any time exceeding this allowance will be charged at the Company’s standard hourly demurrage rate (£50 per hour or part thereof).

8. Governing Law

These conditions and any act or contract to which they apply shall be governed by English Law, and any dispute arising out of any act or contract to which these conditions apply shall be subject to the exclusive jurisdiction of the English Courts.
